Alameda Family and Medical Leave Act Attorney

The Family and Medical Leave Act (FMLA) protects employees who must take time off from work due to sickness, pregnancy, needing to care for a family member and other scenarios. If you take FMLA leave, your employer cannot retaliate against you. If your employer has terminated you in violation of FMLA, turn to Bohbot & Riles for guidance.

Who is eligible for FMLA?

To be eligible for FMLA, your employer must have at least 50 employees in a 75-mile radius of the workplace. You must also have worked at least 1,250 hours the previous year.

What type of condition or situation qualifies for FMLA leave?

Our Alameda Family and Medical Leave Act lawyers provide comprehensive, personalized legal services to people who take leave for any illnesses or injuries that are considered "serious health conditions." These conditions do not always have to be something you are experiencing. For example, you can take FMLA to care for a sick child. Talk to our law firm about:

  • Parental leave
  • Maternity leave
  • Paternity leave
  • Disability leave
  • "Family care" leave (to care for a sick spouse, parent, grandparent, sibling or child)
  • Pregnancy leave (due to morning sickness or bed rest)
  • Sick leave
  • Surgery leave
  • Recovery leave (recovering from surgery)

The time off under FMLA does not have to be consecutive. You are protected for up to 12 weeks of unpaid leave in a 12-month period. You cannot be fired or otherwise retaliated against for using FMLA.

With 40 years of collective legal experience, our lawyers know that putting your needs before our goals is the surest path to success.
