Many Californians from the baby boomer generation are still working or looking for work. Although employment discrimination against people aged 40 and older is unlawful, the majority of older workers say that they notice their peers being discriminated against. A 2013 survey by AARP revealed that two-thirds of older workers have either witnessed or experienced age discrimination.

A New York employment lawyer said that age discrimination in the workplace is likely to get worse over time because many people in the older generation cannot afford to retire. In an attempt to save money, many companies try to hire younger workers who are willing to be paid less. Another reason that some older workers are discriminated against is because employers have stereotypes about them. Many employers believe that older workers are not as productive as younger workers and do not know how to use modern technology.

The U.S. Equal Employment Opportunity Commission received the highest number of age discrimination complaints in 2008 when 24,582 people over the age of 40 claimed that they had been discriminated against. In 2014, there were 20,588 age discrimination complaints. A senior attorney for AARP said that the economy has an effect on the amount of age discrimination that people experience. She said that certain industries, such as advertising, fashion and technology, have more age discrimination than others.

Age discrimination in the workplace can be very expensive for an older individual who is looking for work. People who have been told that they were too old for a job during an interview may have a case for filing a workplace discrimination claim. An attorney may be able to help an individual to file a complaint and pursue monetary compensation for the damages that have resulted from the unlawful discrimination.
