Tesla unhappy about California discrimination claim

Racial discrimination in the workplace is illegal, but some companies violate the law. After California employees of Tesla complained of racial discrimination, a state agency filed a lawsuit against the company. Now, Tesla is expressing outrage over the move.

What is Tesla saying?

Tesla has expressed anger over the California Office of Administrative Law (OAL) and the Department of Fair Employment and Housing (DFEH) for determining that racial discrimination took place within the company. In 2021, several employees filed claims against Tesla, stating that they were subjected to offensive language, behavior and abuse at one of its plants.

The electric car maker accused the two California agencies of unfairly rushing to conclusions without conducting investigations. As a result, Tesla has since filed a complaint against both agencies to stop the discrimination lawsuit.

Tesla also accused the DFEH of failing to notify it of the claims of racial discrimination and not giving it a chance to settle those claims.

What does the DFEH’s lawsuit against Tesla claim?

According to the DFEH, Black Tesla employees complained about racial discrimination to managers and supervisors as early as 2012. The complaints stated that racial slurs were constantly hurled and that drawings and writings appeared all over the plant. They also said they were subjected to lower-level, lower-paying jobs and fired more often.

One worker who filed a lawsuit in October 2021, was awarded $15 million for the harassment he faced. However, the original verdict, $137 million, was significantly reduced after Tesla disputed it.

A judge has stated that it was likely he would deny Tesla’s motion to stop the racial discrimination lawsuit. The OAL is said to consider the company’s complaint. Meanwhile, Tesla also has other lawsuits pending, including those involving sexual harassment.
